Terms and Conditions (hereinafter "Terms") set out the business terms, rights, and obligations of Pali Gostinstvo In Storitve d.o.o., Petkovškovo nabrežje 19, 1000 Ljubljana, registration number: 2293463000, tax number: SI95383000, (hereinafter "Pali", "FanyandMary.si", "we", "us") and you (hereinafter "user", "client", "you"). You must be at least 18 years old to use our services. Before using the FanyandMary.si portal, which is subject to these Terms of Use, please read the terms below, which apply to anyone accessing our web portal and/or the FanyandMary.si web and mobile application (collectively: "services"). By using our services, you confirm that you agree to these Terms and simultaneously declare and warrant that you are at least 18 years old. If you do not agree with these Terms, do not use our services.

1. SERVICES

FanyandMary.si provides a communication platform between you and various providers offering home food delivery (hereinafter: providers), accessible via the website (https://www.FanyandMary.si) and/or mobile application. Through our website and/or mobile application, you can order and pay for products in accordance with these Terms and have them delivered to your home within the timeframe specified at the time of order. FanyandMary.si is responsible for transmitting the online order up to the point of home delivery.

2. REGISTRATION

To use our services and consequently order home delivery, the user must first register. User registration is done via an online interface where the user enters their information. By registering, the visitor becomes a user, gains the right to purchase – submit orders – and automatically accepts these Terms and agrees to the handling, protection, and transmission of personal data as described in the "Privacy Policy" section.

Each user receives an activation code on the mobile phone provided during registration. The user can start shopping after confirming the code. Upon registration, the user receives a FanyandMary.si account, consisting of a username and password, which grants access to certain parts of the website. The user is solely responsible for the confidential management of their account and safeguarding their password against unauthorized third-party access. FanyandMary.si is not responsible for potential misuse of the user account. The user acknowledges and accepts the consequences if they choose a password easily guessed by others or fail to log out on a shared computer. Users must not share their password with anyone and are responsible for all activities from their account.

By registering, the user confirms that they have provided true, accurate, and complete personal data. Registering on behalf of another person or entering someone else’s information without permission is prohibited. Any violations or misuse should be reported to the competent authorities.

3. ORDER PLACEMENT AND CANCELLATION

Placing an order confirms the request for delivery of selected products. If the user selects payment by card and completes the payment at the time of order, the order cannot be canceled afterward. Refunds are only possible if the ordered item was not delivered due to a provider’s error.

The user may choose to pay the delivery person directly. In this case, the user is obliged to pay the full order amount to the delivery person. Modifying or canceling the order after submission through our portal is not possible. Cancellation can only be checked by calling to see if it is still possible. FanyandMary.si is obligated to deliver the food within the timeframe confirmed by the user. In exceptional cases where orders cannot be delivered on time due to circumstances, the provider must inform the client.

4. PRICES

All prices on our portal are in EUR and include VAT unless otherwise stated. The website displays final prices; in some cases, delivery and/or packaging fees are not included. In such cases, the provider will add the missing amount to the total price, and our system will notify you, ensuring you see the final order price before confirmation. Prices may change without prior notice.

5. PAYMENT METHODS

Accepted payment methods for orders placed via the website and/or mobile application are:
(i) Cash on delivery;
(ii) Online card payments with VISA and Mastercard;
(iii) Any other payment methods listed on the portal. You choose the method during the order process:
a. Cash on delivery

Some providers allow cash on delivery. The website indicates whether this option is available. If you select this option, you pay the delivery person when they deliver your order.
b. Card payments via Visa, Mastercard, and Maestro

If you pay by card, you will receive an invoice for the service upon delivery. By paying with a card, you guarantee that you are the owner or authorized user of the card.

After confirming the receipt of the order, changes to the order content or total amount are not possible. For complaints or refunds, contact our support at info@pali.si within 48 hours. If the error is on our side, we will reimburse the costs.

6. PERMITTED USE OF SERVICES

You may use our services in accordance with these Terms and applicable law. You declare and warrant that your use of services will comply with the law, will not infringe contractual obligations, intellectual property, or privacy rights of third parties, and that you are personally responsible for all actions related to service use.

In addition, you declare and warrant that you will not:
a. Use the services in any way that negatively affects other users or impairs, disables, or overloads functions;
b. Use the service for any illegal purpose;
c. Use bots, spiders, scrapers, or other automated programs to access services;
d. Attempt unauthorized access to any service, accounts, computer systems, or networks connected to our service;
e. Illegally access content or information via our services;
f. Infringe third-party rights, including intentionally harming individuals or legal entities;
g. Provide false, inaccurate, or misleading information;
h. Encourage others to engage in any of the above activities.

To ensure transaction and business security, we may request proof of identity. FanyandMary.si reserves the right to disclose data when required by law, regulation, legal process, or government request, or to manage, remove, or refuse publication of any data where reasonably justified.

7. CHANGES TO TERMS

FanyandMary.si reserves the right to modify these Terms at any time. It is your responsibility to review any changes periodically. The date of the last update is indicated in the document. If the updated Terms become unacceptable to you, stop using our services and website. By using our services, you agree to the modified Terms.

8. TEMPORARY OR PERMANENT SERVICE SUSPENSION

We reserve the right to temporarily or permanently suspend access to our services or website without prior notice. We also reserve the right to delete any information or documents related to your use of services or website, particularly if we believe you have: (i) violated the Terms; (ii) created a risk or legal exposure to FanyandMary.si.

9. REPORTING TO AUTHORITIES

The user irrevocably agrees that FanyandMary.si may provide information known about the user to courts, public authorities, telecommunications authorities, or others if there is suspicion of rule violations harming the site or others.

10. PRIVACY POLICY

FanyandMary.si respects your privacy and commits to protecting personal data of all visitors. Data will be protected under the Personal Data Protection Act (ZVOP-1) and not shared with third parties without consent. Reasonable technical and organizational measures are in place, but misuse cannot be completely excluded due to the nature of the Internet.


All personal data provided by users is intended exclusively for use on the website and for service administration. FanyandMary.si is not responsible for the accuracy of data entered by users.
The collected data will be used or disclosed by the provider only with your consent or in cases where such an obligation is required by law or in good faith that such action is necessary for proceedings before courts or other government authorities.

By registering on the website, you agree with the method of protecting, handling, and transmitting your personal data as described in the privacy policy. When choosing a password that allows access to certain parts of the website, you are responsible for keeping this password confidential. We advise you not to share your password with anyone.

We process the following personal data:
• Identification and contact information: email address, first name, last name, and hashed password;
• Data required to complete an order: address, phone number, delivery notes, invoicing information, contents of ordered items;
